Question

I recorded a song at a producers house. I ran across a website where he is selling my song online for .99 a download. There were no contracts signed and no verbal agreements. I stopped working with him after 1 month because he was trying to change my style. What should I do now?

Answer

You could sue him for copyright infringement.

If the song is registered, you could get your attorney's fees as well as statutory damages.

Answer

In Maryland disinterments should first go through an approval process with the state's attorney and next-of-kin needing to sign off.

Other issues with cemeteries are governed by the state Office of Cemetery Oversight; tel. 410 230-6229

While not legal advice, I hope the above helps.

Question

Dual custody child support

I have been paying my ex wife alimony and child support for my 11 year old son. He has decided that he wants to live with me 1/2 of the time. My ex wife agreed but does not believe she should reduce the amount of child support. She is remarried, just bought a house and is having another child. She told me she depends on my money to survive. Is this my responsibility or should I explore reducing my support? I want to do what is fair, but I think that if I have him 1/2 time I don't think it is fair to me to continue paying the full amount. Any advice you could provide would be welcome. Sincerely, Good, responsible dad in MA

Answer

Re: Dual custody child support

Hi, It sounds like you have a good argument for child support reduction if your son lives with you half of the time. There are many different factors that the judge takes into consideration when modifying child support - so it would be best if you consulted an attorney.

Re: Dual custody child support

First, if she has remarried, you should not be paying alimony. If your divorce judgment doesn't automatically terminate alimony on her remarriage, you should seek a modification.

As for child support, the new child support guidelines made some significant changes to the way support is calculated, and the basic calculation assumes that the child will live with the primary custodial parent 2/3 of the time. If your son is with you half of the time, you will essentially have shared custody (whether or not the judgment calls it that), and the support calculation is different (but almost always produces a lower number).

You have multiple issues that would justify modification, and although none of them is particularly complicated, an attorney familiar with the probate court would be a big help to you.

Re: Dual custody child support

Congratulations on being a responsible Dad.

If your ex wife will not agree to join with you in submitting a joint petition for modification, you should retain an attorney to assist you in drafting a modification complaint as alimony should cease upon her remarriage and the amount of child support should decrease based on the changed circumstances of her having the child only half the amount of time and perhaps having less expenses on her financial statement due to her remarriage. Good Luck!

Re: Dual custody child support

That sounds like a reasonable ground to seek a Modification order from the family court.
