Question

I was injured on my way to work. Do I have a worker's compensation case?

Answer

You need to provide much more information. The normal commute to and from work is not considered work related. You must be doing some service for the employer aside from showing up to work [carrying tools, driving to a different location then were the business is, making a sales call first and then going to the office, etc.]. If you provide more details I can give a more definite answer.

Just based upon the facts in your question, your claim may be wiped clean by the Going and Coming Rule. Unless you can prove that you were on some sort of special mission for your employer at the time of your accident, then I would say that the prosecution of your case may be difficult. Question

bankruptcy petition & schedules

I filed chapter 7 and just received notice from the trustee requesting a copy of the debtors signed petition and schedules. Do I need to send him the ENTIRE copy of the bankruptcy pettion that I previously filed with the district bankruptcy court? Thank you.

Answer

Re: bankruptcy petition & schedules

Yes. You must immediately send a photocopy of the COMPLETE petition to the trustee, together with your last tax return, your pay stubs, and your credit counseling certificate.

Since you do not have an attorney, you must proceed very carefully. There are a great deal of rules under the new bankruptcy laws and your case can be dismissed if you neglect to adhere to them. Many pro se cases get dismissed because the debtors do not do what they are required to do.

There is a lot of information on my bankruptcy blog about the various filing requirements:

Good luck!

Answer

Re: cheating husband

She may want all of his stuff there. Sounds like a plan to me.

Can you get in trouble for going on her property to drop it all off? Maybe, but I have yet to see door to door sales people arrested for trespassing. Let me say that there are no guarantees.

Question

I have a summary offence trial coming up for a underage possession of alcohol charge in my dorm which was not mine and i have an RA report that shows that I wasn't even in the room at the time. I'm just wondering if I can get a public defender for a summary trial or whether I should just represent myself and state my case ?

Answer

No, to be entitled to a lawyer you have to be looking at 6 months or more in jail.
